Winter Start 2026: New Terms and Conditions and Kilometre Charge

The year 2026 has begun with a true winter. Abundant snow and challenging road conditions make this a logical moment to reflect on the parameters within which we operate.

During this quiet winter period, we have thoroughly reviewed the new General Terms and Conditions of our industry association, Vereniging Verticaal Transport (VVT). These conditions have been updated and apply to the entire sector. To maintain clarity, we have internally listed the most important changes so that we can work with them correctly and transparently in practice.

Kilometre Charge for Mobile Cranes
In addition to these contractual changes, another significant development awaits us in 2026: the introduction of the truck levy.
As of July 1, 2026, the Dutch government will implement this kilometre charge for:

* transport vehicles
* mobile cranes

The charge applies to almost all motorways and a large number of provincial and municipal roads. This is a mandatory measure affecting the entire transport and lifting sector.

What does this mean in practice?
We are currently assessing the exact costs and implications as carefully as possible. As soon as more clarity is available, these costs will be passed on – in accordance with sector-wide regulations. Naturally, we will maintain transparency and timely communication with our clients.

The main differences between the General Terms and Conditions VVT 2010 and the most recent 2025 version
1. Structure and layout

2010 version:
Consisted of General Terms and Conditions and Special Terms and Conditions (I: Rental of equipment/personnel, II: Transport, III: Storage/Transshipment).
2025 version:
The same basic structure, but expanded with more definitions and clarifications regarding digital communication, liability, and insurance.

2. Definitions

New in 2025: Addition of terms such as:
“Project Duration”, “Change Orders”, “Contract Price”.
Increased emphasis on digital documents and electronic communication.

3. Applicability and Hierarchy

2010 version:
General terms and conditions were standard, Special terms and conditions took precedence in case of conflicts.
2025 version:
Same principle, but explicitly added that the most recent version always applies and that digital publication on the VVT website is leading.

4. Liability and Insurance

2010 version:
General provision that the contractor is liable for damages caused by their own errors.

2025 version:
More extensive clauses on
Limitation of liability (e.g., maximum invoice value or a specific amount).
Mandatory insurance for damage caused by cranes and lifting equipment. Exclusion of indirect damages (e.g., consequential damage, loss of profit).

5. Payment Terms

2010 version:
Payment term usually 30 days.

2025 version:
Still 30 days, but now explicitly without set-off or suspension and with stricter interest and collection provisions for late payment.

6. Change Orders and Additional Work

New in 2025:
Clear regulations for change orders (additional costs, conditions, written confirmation).

7. Digitalization and Communication

New in 2025:
Acceptance of digital signatures, electronic communication, and online publication of terms and conditions as legally valid.
